Every person brings unique characteristics to dealing with illness: a particular personality, a way of coping, a set of beliefs and values, a way of looking at the world.

Being ill makes a person feel alone and we should never place blame as this only adds more feelings of distance and isolation.

We know a lot about the ways that our personality and emotions leads us to engage in habits or behaviors that increase our risk of getting cancer.

Good examples are smoking and lung cancer, or sunburn and malignant melanoma.

People today have many questions based on what they’ve read and what their friends tell them about cancer.

Questions

Some questions are:

1. Did my personality or emotions cause my cancer?
2. Did stress alter my immune system and caused my cancer?
3. Did grief or a loss cause my cancer, and could it make the cancer come back?
4. When I get down and depressed, am I making my tumor grow faster?
5. How important is support from others?
6. Can support groups help me live longer?
7. How can I help to make my treatment work?

Many people’s first experience with cancer begins with the discovery of a symptom or sign known to be a possible cancer indicator.

A breast lump, a sore that has changed in appearance or hasn’t healed properly, any persistent severe pain, blood in the stool or urine, a sore throat or cough that persists-these are several of the most common signs.

Many people who notice a “suspicious” symptom have encountered cancer before through the illness of a loved one, such as a parent or grandparent.

Others have not had such a personal experience but have seen cancer statistics in the media or heard about it within their community.

American Cancer Society

According to the American Cancer Society, about one out of eight invasive breast cancers develop in women younger than forty-five.

About two out of three invasive breast cancers are found in women fifty-five or older. In fact, the aging process is the biggest risk factor for breast cancer.

That’s because the longer we live, the more opportunities there are for genetic damage to occur in the body. And as we age, our bodies are less capable of repairing genetic damage.

That’s why it’s so important to take care of ourselves by eating right, exercising several times a week, maintaining a healthy weight, not smoking, and living a healthy lifestyle as we age.

Dense Breast Tissue

About 45% of women age forty to seventy-four have dense breasts. The younger you are, the denser your breast are.

Dense breast has been known to have more fibrous and glandular tissue than fatty tissue, which can make it difficult for a radiologist to detect cancer on a mammogram. Fatty tissue is dark, so any cancer is more visible.

National Cancer Institute

According to the National Cancer Institute, specific inherited mutations in BRCA1 and BRCA2 increase the risk of female breast and ovarian cancers, and they have been associated with increased risks of several additional types of cancer.

Together, BRCA1 and BRCA2 mutations account for about 20 to 25 % of hereditary breast cancers and about 5 to 10% of all breast cancers. In addition, mutations in BRCA1 and BRCA2 account for around 15% of ovarian cancers overall.

Breast and ovarian cancers associated with BRCA1 and BRCA2 mutation can be inherited from a person’s mother or father.

Each child of a parent who carries a mutation in one of these genes has a 50% chance (or 1 chance in 2) of inheriting the mutation.

Here’s another interesting fact-Studies also show that lack of regular exercise can impact the likelihood of developing breast cancer.

Even more reason for me to stay in the gym. Lol!

Testamentary Capacity, Holographic Wills and Living Trusts vs. Wills

A few years ago I acquired more information regarding making a valid will in the Cayman Islands.

The execution requirements for making a valid will in the Cayman Islands are set out in the Wills Law (2004 Revision).

It is also a requirement of Cayman Islands law that a testator must have testamentary capacity at the time of creating his or her will.

The test for testamentary capacity, known as the “golden rule,” was first explained in the English case of Banks vs. Goodfellow and it remains good law in the Cayman Islands today. Here are the facts:

(a) Does the testator understand the nature and effect of what he/she is doing;

(b) Is he/she aware, broadly, of the extent of his/her estate;

(c) Does he/she appreciate the claims of those who might reasonably expect to benefit from his/her estate; and

(d) In considering (c), is there any disorder of the mind or insane delusion that will influence the disposition of his/her property or poison his/her affections such that he/she would make a disposition of property that he/she would not otherwise have made.

In summary, the Wills Law provides that a will must be in writing; it must be signed by the testator or by some other person in his/her presence, at his/her direction.

If the latter, the testator must acknowledge such signature in the presence of two witnesses present at the same time.

If the former, the testator’s signature must be attested to by two witnesses present at the same time in his/her presence.

Subject to only two exceptions for soldiers and sailors on active service, the execution requirements must be complied with; if not, it will be invalid.​

Holographic Wills

Unfortunately, the Cayman Islands law does not, as a general principle, permit holographic wills.

Holographic wills are documents that are usually handwritten and do not comply with the strict requirements for proper execution as a will but have nevertheless been written as testamentary documents, often in extreme circumstances.

​Famous Holographic Will

The most famous holographic will was that of Cecil George Harris, a Canadian farmer who in 1948 suffered the misfortune of becoming trapped under his tractor and fearing that he was about to die, carved a will into the fender which read, “In case I die in this mess I leave all to the wife. Cecil Geo. Harris.” The fender was submitted to probate as his valid holographic will.

Testamentary Capacity

Apparently in the common law tradition, testamentary capacity is the legal term of art used to describe a person’s legal and mental ability to make or alter a valid will.

This concept has also been called sound mind and memory or disposing mind and memory. Cool!

I also learnt that Testamentary intent refers to a testator’s intention with respect to a particular instrument that functions as his/her last will.

Testamentary intent is required for a will to be valid.

Then we have to consider the person’s legal capacity to enter a contract:

One of the elements of a contract is capacity. Capacity means that a person is legally able to enter into a contract.

There are several things that make a person legally able to do so, including age and state of mind.

A person who is in the end stages of Alzheimer’s disease probably does not have the requisite capacity to sign legal documents.

However, a person with a diagnosis of dementia may very well be able to sign legal documents. Generally speaking, capacity is usually analyzed situationally.

The other way to change your will is by adding what is called a codicil. A codicil is like an amendment or addition to your will.

Use a codicil to revoke part of your will or add a new provision.

To be valid, they must be dated, signed, and witnessed just like a legal will.

I learnt that it is extremely important to keep your will updated. As life changes, so do potential beneficiaries and heirs.

Updating Your Last Will and Testament

If you do not keep your last will and testament updated, it may not reflect your wishes given your new circumstances. The following are good situations in which changing a will may be wise.

  • Marriage:
    • When you get married, both you and your spouse should each create a new will.
    • Most states have laws that award a percentage of your estate to your spouse upon your death.  
    • However, if you want to devise your will differently, you should specify this in your will.
    • Furthermore, adding your spouse to your will may change the percentage of your estate, or of a specific asset, that another beneficiary or heir was previously written to receive.
    • Changing a will should reflect this new proportion as you see fit.
  • Common Law Marriage:
    • The following information was all I could find that would classify eligibility:
    • Any person who has been married to a Caymanian-

v      for at least five years immediately preceding the application, where the marriage took place prior to the 1st January 2004; or

v      for at least seven years immediately preceding the application, where the marriage took place on or after 1st January 2004

v      whose marriage is not a marriage of convenience;

v      who is not living apart from his spouse under a decree of a competent court or under a deed of separation;

v      who has not lived apart from his spouse for an aggregate period of three months

v      out of the five years immediately preceding the application where the marriage took place prior to 1st January 2004; or

v      out of the seven years immediately preceding the application where the marriage took place on or after 1st January, 2004.

v      who is legally and ordinarily resident* in the Islands immediately preceding his application; and

v      who has not in any country been convicted of an offence for which a sentence of imprisonment not exceeding twelve months has been passed other than for non-payment of a fine unless-

1.      the conviction has been quashed on appeal or has been the subject of a free pardon;

2.     the act or omission giving rise to such conviction would not be an offence if done or omitted in the Islands in similar circumstances; or

3.     the conviction is one which, in the interest of justice, the Board directs to be ignored for the purposes of this section,

  • Obtaining a new partner, without marriage:
    • Only if married will your partner automatically receive assets from your estate.
    • So, if you find yourself with a new loved one, changing a will to reflect what you would like to leave that partner is necessary.
  • Divorce:
    • Upon divorce, some states revoke any gifts you leave your spouse in your will. Other states do not.
    • Changing a will upon a divorce is very important.
    • You will want to either specify what you want to leave your former spouse, or else specify how those gifts should now be distributed.
  • A new baby:
    • There are laws in some states that give children some portion of your assets upon your death.
    • However, not everyone wants their property to be distributed the way the state laws specify.
    • If you welcome a new baby into your family, be sure to specify what gifts, the baby shall receive, by changing a will.
    • Perhaps more importantly, be sure to appoint a guardian for the baby.
    • This will be the person who will care for your baby should anything happen to you.
  • New stepchildren:
    • Stepchildren are not automatically entitled to inherit a share of your property in many states.
    • Therefore, if you would like for your stepchildren to inherit any of your property, be sure to specify your wishes by changing your own will.
  • Moving from a community property state to a common law property state:
    • The laws governing what each spouse owns vary depending on whether the couple lives in a community property state or a common law property state.
    • Therefore, if you are planning on moving to a new state, check that states laws.
    • If it differs from the one you currently reside it, be sure to change your own will, according to your new property ownership status.

i.e.    Persons of independent means:

The Cayman Islands Government offers five Immigration products for wealthy, private investors and senior executives who are seeking long-term residence in the Cayman Islands.

1.      Certificate of Permanent Residency for Persons of Independent Means (Form R5) – Persons who invest a minimum of two million Cayman Islands’ Dollars in developed real estate in the Cayman Islands may apply for a Certificate of Permanent Residence for Persons of Independent Means.

As the Certificate title denotes, a holder has the right to reside indefinitely in the Cayman Islands.

A holder will also have the option of seeking naturalization as a British Overseas Territories Citizen and, thereafter, the right to be Caymanian.

A holder and his spouse may also have their permission to remain varied to allow the right to work in the Cayman Islands.

2.      Residency Certificate for Persons of Independent Means Form R2 – This facility is for persons who wish to reside long-term in the Cayman Islands without the right to work.

Applicants will be required to demonstrate that they have invested a prescribed minimum amount in developed real estate in the Islands and that they meet certain financial standing requirements.

A successful applicant will be granted permission to reside in the Islands for a period of 25 years (renewable). This residence type cannot be varied to allow the right to work.

3.      Certificate of Direct Investment Form R8 – The Certificate of Direct Investment is for persons who invest, or propose to invest, a minimum prescribed amount in a licensed employment generating business in the Cayman Islands and in which he/she will exercise substantial management control.

An applicant must demonstrate a substantial business track record or an entrepreneurial background, including specific professional, technical and other knowledge relevant and necessary to carry on the business.

4.      Residency Certificate (Substantial Business Presence) Form R6 – This facility is for persons who invest in, or who are employed in a senior management capacity within, an approved category of business in the Cayman Islands.

A successful applicant is granted a Residency Certificate valid for 25 years (renewable) which entitles him to reside in the Islands and to work in the business in which he has invested or is employed in a senior management capacity.

  • Changing your mind about heirs: Of course, things can happen in life that cause people to change their minds about the way in which they’d like their property distributed. Changing a will to reflect these new wishes is important.
  • New or disposed of assets: Perhaps in your will you would like to leave all of your property or a percentage of your property to your heirs, then what you own changes and there is no need to change your will. However, if you have willed certain gifts to people in your will, and you no longer have those properties, be sure to remove said property from your will. Additionally, when you acquire new property, be sure to account for that in your will.

Ways of changing a will

The easiest way of changing a will is simply to make a new will. It is imperative that you revoke the old will.

To do this, simply write a statement in the new will that states that you revoke all wills and codicils that you have previously made.

This is sufficient to revoke any previous wills, but it is wise to also destroy any of your previous wills in order to avoid confusion or challenges to your new will.

The other way to change your will is by adding what is called a codicil.

A codicil is like an amendment or addition to your will. Use a codicil to revoke part of your will or add a new provision.

To be valid, they must be dated, signed, and witnessed just like a legal will.

Codicils were an efficient way of changing a will before there were computers and printing was a hassle.

Today, codicils should be avoided wherever possible. They can cause confusion, be lost, and are sometimes even a means to challenge wills.

That information is definitely worth remembering!

Changes to other estate documents

Much of your property passes by law to beneficiaries, despite what your will says.

Property such as retirement proceeds, life insurance proceeds, joint bank accounts, payable-on-death bank accounts, and stocks registered with a transfer-on-death form all pass directly to a specified beneficiary.

If you change your mind about who the beneficiary should be, change the names using the forms on which you named the original beneficiaries.

Do not change the named beneficiaries through your will, for it will have no effect.

Living trusts are also not affected by the terms of your will. If you decide to change the terms of your living trust, add an amendment to the original trust document. Then, transfer property in or out of the trustee’s name, accordingly.

You do not need to worry about having to revoke a trust and create an original one, like when changing a will.

Living Trust

What Is a Living Trust?

Aliving trust is a legal document, or trust, created during an individual’s lifetime where a designated person, the trustee, is given responsibility for managing that individual’s assets for the benefit of the eventual beneficiary.

A living trust is designed to allow for the easy transfer of the trust creator or settlor’s assets while bypassing the often complex and expensive legal process of probate. Living trust agreements designate a trustee who holds legal possession of assets and property that flow into the trust.

How Living Trusts Work

However, this stipulation means the assets in the trust remain a part of the trust settlor’s estate, meaning the individual may still be liable for estate taxes should the estate be valued beyond the estate tax exemption at the time of death. The trust settlor also has the power to change and amend trust rules at any time. This means the trust settlor is free to change beneficiaries or undo the trust altogether.  

Irrevocable Living Trust

With an irrevocable living trust, the settlor relinquishes certain rights to control over the trust. The trustee effectively becomes legal owner, but the individual would also reduce his or her taxable estate. Once the trust agreement for an irrevocable living trust is made, the named beneficiaries are set and the settlor can do little to amend that agreement.

When you die, this creates a change of beneficiary or beneficiaries. The person or persons you named in your trust documents to inherit from you become the new beneficiaries upon your death. They now own the assets you placed in your trust, according to the terms you decided when you made it.

Advantages to using a Trust over a Will

Wills and Trusts are both estate planning documents used to pass assets on to beneficiaries at death.  However, there are distinct advantages to using a Trust over a Will.  Here are five ways in which a Trust is better than a Will to pass your estate to your beneficiaries.

  1. A Trust can be used to Avoid Probate – a Will cannot. Probate is the process of changing the title on assets when someone passes away.  Assets that are owned in a deceased person’s individual name and for which there is no named beneficiary are no longer accessible once the owner of the asset has died. In order for family members to gain access to accounts or other assets in the deceased’s individual name, they must file a petition with the probate court and wait for the court to approve the Will and appoint the Personal Representative.  This can be a long and costly process during which bills cannot be paid and assets cannot be managed.  A Trust is an excellent probate avoidance tool because assets that are owned in the name of a Trust are immediately accessible to the trust-maker’s designated successor.
  2. A Trust can provide Creditor Protection for the Inheritance you Leave to Beneficiaries – a Will cannot. Many people worry that the inheritance they leave to their children will be lost to their children’s creditors such as a divorcing spouse, unpaid credit card bills, a bankruptcy, a business loss, or a lawsuit.  Sadly, this is often the case when assets are distributed to beneficiaries via a Will.  A Trust allows the maker to safeguard an inheritance from the reach of the beneficiaries’ creditors by keeping the assets out of the name of the beneficiary.  Ownership of the assets remains in the Trust.  The beneficiary will have access to the assets in accordance with the directions you leave in your Trust. You may also allow your beneficiary to serve as Trustee, allowing the beneficiary to manage her own inheritance.  By leaving assets to your beneficiaries via a Trust rather than outright via your Will, you can ensure that the assets you worked so hard for will be available to your children and future generations.
  3. A Trust can Protect Governmental Benefits for a Person with Disabilities – a Will cannot. If you have a child, grandchild or other beneficiary with disabilities, then a Trust is a must.  If you leave assets to a person who receives needs-based governmental benefits via your Will, it will place your beneficiary in the difficult position of either losing those benefits, or transferring the inheritance into a Trust of which the state must be the beneficiary at the beneficiary’s death.  Unless the inheritance you are leaving is so significant that the monetary and medical benefits available to the person through programs such as Social Security and Medicaid are no longer important, then making sure that those governmental benefits continue to be available is vital.  Leaving assets to a person with disabilities via a Trust is the best way to ensure those governmental benefits are preserved and that the inheritance you leave will be available to pay for expenses that are not covered by these governmental benefits, which while vital to many, are limited in their scope.
  4. Trusts can Reduce Estate Taxes – a Traditional Will cannot. Many married couples have so-called “I-love-you” Wills, which leave all assets outright to the surviving spouse upon the first death.  If you have an estate of more than $1,000,000, then using “I-love-you” Wills means that money you think you are leaving to your beneficiaries will in fact be going to the Commonwealth of Massachusetts in the form of estate tax payable at the surviving spouse’s death.  If you would prefer that your assets pass to your family, create Trusts to reduce estate taxes.  Estate tax planning via Trusts for married couples is standard planning and permissible under both state and federal tax laws.
  5. A Trust can Administer Assets for Minor Beneficiaries without Court Intervention – a Will cannot. Leaving money directly to a minor creates an administrative nightmare because the law provides that a minor does not have the legal capacity to receive assets. The parent of the minor also does not have the ability to act as the child’s legal representative until the court says so.  As such, if you die with a Will that leaves money to minor beneficiaries, the court will need to appoint a Conservator to receive that inheritance for your children.  The Conservator will be required to report annually to the court and the court will appoint an overseer (guardian ad litem) to make sure the Conservator is doing his or her job for your minor beneficiaries.  This means huge costs and long delays in administering funds for minors.  It also means that when the minor turns 18, he or she will be entitled to receive all of those assets and will be free to do with them as he or she wishes (think fast cars, spring break, and lots of shopping).  Creating a Trust to receive assets passing to a minor, or even to a young adult beneficiary, is the best way to ensure that the court is not involved in the process, that the person  you want to manage assets for the beneficiary is able to do so, and that the beneficiary can use  the assets only for purposes you decide are important and/or at ages that you dictate.

These are just five ways in which a Trust is superior to a Will.

When There is no Will

According to Robert Mack, HSM Chambers, most people know that making a will is the “adult thing” to do, especially when children and other dependents are involved.

However, like most unpleasant things in life, we tend to put it off for as long as possible.

In some tragic cases life can end suddenly and unexpectedly, or a person can be struck down by illness and lose their mental capacity which would otherwise prevent them from creating a valid will.

Let’s also not forget that digital assets fall into two broad categories: valuable and sentimental.

Valuable digital assets include such things as cryptocurrencies, online investment/bank accounts, online store credits, intellectual property, and anything else which has a tangible dollar value attached to it.

Sentimental digital assets, on the other hand, include photographs, personal videos, blog posts, social media accounts, and information held in email messages.

In today’s world with all of its innovations and advance technology, you can communicate virtually from anywhere.

Sometimes charm is not enough. Arriving with the proper introductions and support is essential to developing workplace rapport. This is especially critical if you do not fit the local people’s stereotype of the Foreign V.I.P.

It was also concluded that those with the most effective communicative ability also had the less employee turnover. Our local newspapers inadvertently record daily, companies who are constantly and consistently seeking new hire. Why is that?

Early Inventions and Patents

The Fax (Facsimile) Machine

The fax (facsimile) machine is considered one of the oldest inventions. It is even older than Alexander Graham Bell’s telephone. Patents for the first fax machine dates back nearly 150 years.

Giovanni Caselli

The first commercial fax system was invented and patented in the United States in 1863 by an Italian priest, Giovanni Caselli, who helped establish a fax line between Paris and Lyons for five years, 1865-1870.

At the time, Giovanni was considered “some kind of a nut” with his scientific “junk” scattered all around his home. The Italian priest’s small home looked more like a mad scientist’s workshop than the residence of a man of the cloth. Giovanni worked alongside Alexander Bain, who was an expert clockmaker, for seven long years from 1857-1864, refining and improving the fax machine and Bain’s clock-driven pendulum idea.

Finally, in 1863 Giovanni Caselli made major improvements to the fax design:

•He installed a separate clock in the transmitting end that synchronized the pendulums on each perfectly. •His fax did not require the original to be scratched in metal or written in special ink. Ordinary ink worked.

•Originals could be reproduced in the same size or reduced.

•Different messages could simultaneously be transmitted through a single wire. While decorative and flowery pictures were occasionally faxed, the fax line was predominantly used to carry stock market information between 1866 and 1870. Eventually the fax caught the attention of the press, mainly because they could clearly see its benefits to their industry.

Newspapers and magazines praised the new invention for its public service.

“Who could do better?”

Wrote a journalist at the time. But the interruption of the 1870 war and the siege of Paris, saw the era of the mechanical fax machine with their pendulums and clockworks coming to an end.

At the turn of the century, mankind had upgraded to the modern fax machines that used light beams to read and write and had replaced the swinging pendulums.

Pictures by Fax – In 1902 physicist Arthur Korn of Germany dramatically improved English inventor Frederick Bakewell’s rotating drum idea. He constructed his cylinder out of glass, positioned a selenium cell inside, and wrapped the intended fax around the cylinder. By shinning a light through the picture and onto the selenium, Korn’s machine accurately converted the picture into electrical signals. On the other end, the signal was converted back to light and was shone on photographic film.

As a result, a permanent copy was created. Arthur Korn’s system was an overwhelming success, especially for the newspaper business, which was rapidly growing in circulation at the time.

The fax machine was quickly becoming indispensable to the press and realizing the machine’s value in the competitive newspaper business, the French newspaper at the time called L’Illustration bought out Arthur’s rights to the machine in 1906 and monopolized its use in France.

As I said before, we have become a very interactive and open world. Privacy is now a highly sought commodity! Especially for Public Figures and Celebrities and I can seriously understand all the reasons why.

However, let me not deviate from my own message which I’m trying to communicate. (Lol!)

The Telephone- Alexander Graham Bell (Patented on the 14th February 1876

Alexander Graham Bell is famous for inventing the telephone, but during Bell’s era another experienced inventor called Elisha Gray took Bell to court in the 1870s, suing for the patent rights to the talking machine.

Elisha Gray, (born Aug. 2, 1835, Barnesville, Ohio, U.S.—died Jan. 21, 1901, Newtonville, Mass).

Obviously Gray did not win the patent rights as Bell is credited with the invention. However, history might have recorded Elisha Gray as the inventor if Bell had not beaten him to the patent office by a few hours on February 14th 1876.

The story is one of the most fascinating and illustrative of the contrast in style between two different types of men: My studies claimed that one man was steered by the promise of fortune and fame, while the other strictly believed in the pursuit of knowledge as his own reward.

Even after winning his patent Bell could not convince big businesses or Elisha Gray of the telephone’s usefulness. Gray was known to refer to the invention as a “beautiful scientific toy”. Bell even offered to sell his telephone patent to Western Union https://www.britannica.com/topic/Western-Union-Corporation but it was rejected by the company. A few years later, the very same company tried to strip Bell of his patent in a lawsuit with Elisha Gray.

Many agree that Gray was definitely an able and diligent scientist who had independently arrived at the same conclusion as Alexander Bell, but the courts were convinced that Bell deserved the patent.

To Elisha Gray, as a self-assured business man, the telephone was an annoying curiosity, almost in the same category as a hobby. However, to Bell, an amateur inventor working virtually alone, the telephone was his life.

The Self-Service Supermarket

Clarence Saunders (9th August 1881- 14th October 1953) was a flamboyant and innovative man who thought there was a waste in manpower and space in the conventional stores of his time. It might sound strange, which it did to me when I came across this information, but the idea of a supermarket was indeed patented.

According to Inventing the 20th Century,100 Inventions that shaped the World by Stephen Van Dulken, Saunders idea was filed on the 21st October 1916 and published as US patent # 1242872. C. Saunders – Self Serving Store: Patented October 9th 1917 He named the new chain Piggly Wiggly ® and franchised the format as high-volume, low-profit margin stores. The Supermarket chain is still in operation to this day.

Apparently, there is a legend told about the unusual name of the supermarket chain. Saunders stated that he once saw from a train several piglets trying to get under a fence. Lol!

Over the next several years Saunders patented several improvements to the concept of a self-service store, as well as such ideas as price tagging, a lightening system for self-service stores and tape for adding machines. Dispute with the New York Stock Exchange left him bankrupt and he never was able to live in the huge house in Memphis which he had started to build.

It is now the Pink House Museum, and contains a replica of his first supermarket. Inventing is a very tough business. It takes a thick skin and the ability to keep smiling after constantly hearing “no”. With the death or departure of the founder of any innovative invention, quality often gives way to quantity.

Communication 101

In a survey of 480 companies and public organizations by the National Association of Colleges and Employers, the ability to communicate ranked first among personal qualities of college graduates sought by employers. We deliberately communicate through writing, reading, speaking and listening and according to Henry Mintzberg in The Nature of Managerial Work, Chief Executive Officer’s (CEO), spend allmost every minute of their day communicating.

In any organization, people communicate in many ways. Face-to-Face communication takes place during one-on-one discussions, in informal groups, and during meetings. However, when individuals communicate face-to-face, they experience the most effective form of communication. Both nonverbal cues and verbal communication supply immediate feedback.

The critical question for you to ask yourself when communicating is, “What is my objective?”. Do you want to motivate others to support a new or existing idea? Do you want to encourage healthy open dialogue or are you just disseminating useful information?

Miscommunication or no Communication

Unfortunately, there are many causes of miscommunication. As we know, right here in the Cayman Islands, we have many people living and working here from around the world and this can sometimes cause personality differences, word-meaning confusion, inferences, gender differences and intercultural differences.

However, I personally do not believe that this should be looked upon as a “bad thing” but as a necessary catalyst for stimulation and growth for our economy. Individuals from different cultures bring different perceptions, value systems and different languages to the workplace.

Yes, it may cause miscommunication but hey, most people are good people and there might be something you can learn from them and vice versa! I strongly believe we just need to be more sensitive and aware of an individual’s background and experience when communicating in order to be our most effective. We should also check to see if there are any hidden biases and if we are forming an opinion regarding certain people based on their sex, religion, age, race or simply because they belong to a particular group.

Prejudging people may make it difficult to communicate with them. And I can’t stress enough that we should avoid stereotyping and the use of sexist, racist or ethnic remarks.

Feedback

Immediate feedback is best but sometimes not realistic. Feedback reports to the sender that the receiver (the decoder) received and understood the message. When the receiver responds to the sender, the communication process starts over again. Feedback therefore makes communication a two-way process, allowing the sender to become a receiver and vice versa.

Sometimes personal reflections can be a source of feedback when you make observations of yourself in action. You might ask yourself, “Wow, was that really me? I didn’t think I could really do it,” or “Why didn’t I think of doing this before?” Or, you might observe a certain scenario and state, “This didn’t really work the way I planned it, but the reality turned out to be better than I could have hoped for.”

Other people are also great for feedback, with one being the sender and the other being the receiver. Sometimes we need constructive observations of our actions towards others. Someone may tell you,

“I didn’t think you had the guts to actually remain in such a toxic environment for so long. I know I couldn’t. I’m very impressed with you!”

or,

“Ever since you returned from college, you’re like a different person-so strong and decisive and self-confident. I like it!”

Unfortunately, there will always be those people around you who may be jealous of your decisive actions or your self-confidence and may give you negative feedback without any real reason for their comments.

But, if you stop and think about it, you will realize that many times a person’s jealousy is just a way of revealing their envy of you. Either way, the feedback is necessary.

Results are another important source of feedback. By observing the actual effects of your actions on the intended subject, you may be able to clear up misunderstandings and explore each other’s viewpoints. If the necessary debates and negotiations work out well, everyone should feel as if some of their ideas were taken into account.

Even though technology has revolutionized the way we communicate and conduct business, the most vital element of communication remains the continued development of an organization’s most valuable resource-its people.

And the Oscar goes to? Sex and the City

Allegations of sexual misconduct and harassment over the years, whether substantiated or not, have frequently been discussed amongst the community and the places we each call home. It affects virtually all nationalities and religions around the world.

However, even one child or teen being abused by a priest/pastor (or by anyone else) is too many.

Most cases of abuse, although being reported recently, go back two, three, four, or even fifty decades. Unfortunately, there was much less knowledge of the dynamics of abuse then than there is available today. Many times, offenders would be allowed to continue in their ministries after going through a time of brief counseling.

I am not against restoration of an individual, however, I believe it’s worth mentioning that according to research approximately 70% of accused priest/pastors were reported to also be survivors of abuse themselves. Wow!

A psychopath is murdering women across the Midwest. The FBI sends Agent Clarice Starling to interview psychiatrist Dr. Hannibal Lecter, a brilliant, diabolical cannibal who could provide insight into the killer’s identity. Lecter agrees to help Starling only if she’ll feed his morbid curiosity with details of her own complicated life. Starling is forced to confront not only her own hidden demons, but also an evil so powerful that she may not have the courage – or strength – to stop it.

Statistics recorded that many of them had serious psychological problems such as substance abuse and/or mood and personality disorders.

Thankfully, we have elevated our standards and now members of the clergy are more mature when they begin seminary. They undergo intense comprehensive psychological testing’s that includes specific evaluation for sexual problems and risk factors, and they are extensively trained in how to manage sexual issues.

We live in a culture where the sexual abuse of children is not uncommon. There have been reported cases of public and private school children that have been sexually abused or molested by school staff or employees. Regrettably, research also indicates that a greater percentage of children have been abused by family members, rather than by the clergy or school staff.

The publicity surrounding sexual abuse has raised consciousness in many communities of faith, and many have established stringent and detailed policies for ensuring the safety of children and young people.

These often include such things as never having a child alone in a room with an adult; an open-door policy in classrooms; extensive screening and background checks on all personnel who come into contact with children, and detailed procedures for reporting suspected abuse and dealing with offenders.

Child sexual abuse is a complex and serious problem. A few years ago, I attended a Darkness to Light training session at the Red Cross Cayman Islands and was also informed that the training could also be completed online at www.D2L.org

At Darkness to Light, their vision is to have a world free of child sexual abuse. A world in which all children are loved, protected, and nurtured, able to grow up healthy, with their sexual boundaries intact.

Sins that bring Curses

We read in Deuteronomy Chapters 27 & 28 that curses are promised for sins in these six areas: idolatry, dishonoring of parents, dishonesty and deception, cruelty to the helpless, sexual sin of any kind, and disregard for the law. (Some references concerning the sins of the fathers are Deuteronomy 29:24-28; 2 Chronicles 7:19-22; 34:23-25; Ezra 9:4; 13-15; Nehemiah 9:1-3; Isaiah 65:6-7 and Jeremiah 14:20-22; 16:10-13).

The Sins of the Father (Generational Curses: The Dark Tower)

“There is that unseen and mysterious connection between a father’s (also mother’s) sins and the path of their children. If the parent commits certain kinds of sin, regardless of their training, or the social, cultural, and environmental influences on them- the sin or iniquity that is committed is “passed down” to the children, to the third and forth generation.

Each generation adds to the cumulative iniquity, further weaken the resistance of the next generation”.

However, Mr. Stokes also stated that he does not mean to imply that there is any deficiency in the power of the blood of Jesus, which redeems us from the curse of sin, or that believers today are bound to the letter of Old Testament Law. But if we rebel in our hearts and rebuild idols in our lives, we can be ensnared again by the same yoke of bondage from which we’ve been delivered (see Galatians 5:1, 16). Therefore, we again become susceptible to the curse.

Please note however that these insights are not intended to bring you into fear or bondage, nor cause you to attribute every problem in your life, habit, or bad character trait to a curse or a demon. Sometimes emotional and behavioral problems have physiological or biological foundation as I have come to realize.

If we take the time to look at the various issues we have in our lives and become aware of our vulnerabilities, I strongly believe with the help of the Holy Spirit, we can renounce the sins we’ve yielded to in our lives and strengthen our defenses against the evil one.

An example of a prayer may be like this:

“Father, we come before you to confess and repent of our sins
and the iniquity of our forefathers. Forgive us for the sins of idolatry,
witchcraft, rebellion, immorality of any kind, addictions etc. 
According to Ephesians 6:12, we bind all principalities and
powers trying to influence us or our family, and we forbid them to operate in
the name of Jesus. We declare that our Family is under the blood of Jesus; we
revoke any generational curses and say that they will go no further. Jesus
became a curse for us, therefore we are a generation that serves God.
Father, forgive us for depending upon any source that is not
of you. Pour out your supernatural power in our families, so we will not be
bound by the things of the natural world. We ask you to send your warring
angels to do battle on our behalf.  We
thank you in advance that our children will take their place in the body of
Christ and fulfill your calling upon their lives.
Father, we submit to you, and our hope and expectations are
from you alone and no other spirit. By the power and authority of Jesus Christ
of Nazareth, we declare ANY satanic influence directed towards our families
destroyed and defeated by Jesus’ death on the cross.
We thank you for freeing us from the bondage of our past and
cleansing us by the blood of Christ. We also would like to thank you for our
faithful Christian heritage- for those ancestors who did follow you and prayed
for us so that we may become stronger in you and the power of the Holy Spirit. 
We thank you for your mercy and your grace and for the
blessings you bestowed upon us and our families. Amen”.

Demons are Masters of Deceit

Satan’s goal is, through deception, to entice believers to sin or commit any act which quenches the Holy Spirit in their lives or dilutes their effectiveness in glorifying God through both personal conduct and Christian service. His desire is to find any areas in our lives where he can attach himself (See Ephesians 4:27). Through his demons he seeks to find any “sin handles” which give him access to influence us into actions of disobedience towards God.

Satanism is a big problem around the world and it is beyond anything that has been portrayed in the press or in movies. Every city, town or country has its covens, groups or community of people who directly worship and serve Satan.

It doesn’t matter how you “pretty it up” and make it look glamorous, every religion that worships and serves demons is a form of Satanism. Some people refer to them as energies, vibrations, pagan gods, spirit entities etc.

I don’t care! They are still demons!

Demons are masters of deceit. They have the ability in the spirit realm to “switch the sets” just the same as men do in the movie making industry. If you have ever visited Universal Studios, Warner Brothers (WB) etc., where many of the movies are made in America, you can walk down one street and be in the “Old West,” turn down the corner, and you are in 18th century England, turn another corner, and you are in a different time and country, maybe even on a different planet!

Demons can do the same thing in the spirit world and create all sorts of illusions, like modern day magicians for the humans under their control.

I have learnt that in some Eastern religions they center around gaining contact with the spirit world through meditation techniques to blank the mind. My scripture tells me that we are responsible for and should control our own minds at all times. (II Corinthians 10:5)

Visualization and guided imagery are also very old techniques but effective for gaining contact with the spirit world. Apparently, those techniques alone are responsible for thousands of Christians falling into the trap of using occultic practices.

Most important to note is that children go through a developmental stage where they use a lot of imagination and visualization.

During my ongoing extensive research, I was stunned to find out that there are many occultic games and toys for children. Parents should be extremely careful about the toys they buy for their children and the types of video games that they play.

The Bible says we are the temple of the Holy Spirit and just like a house, our temple should be guarded and protected from “unwelcomed doorways”.

What is a doorway? It’s a term used as a sin that defiles the temple.

We can create many doorways and I’ve listed a few above however one such door way is sexual molestation.

Sexual molestation unfortunately is the most common childhood doorways. Apparently, it is always followed by a cycle of early sexual involvement on the part of the child with ever increasing involvement in sexual sins as the person gets older. This is usually because of the demons that may have been placed in the child at an early age.

Children are very vulnerable and should be protected at all cost! However, we adults are susceptible too and should be aware of the basic differences between the Occult and Christianity.

For example, the occultist will always try to control their contact with the spirit world and try to control the person or people within. If they do not do what the they are told, they are then punished. To a large extent, the Satanist appears to be controlling the power they are using for whatever purpose it’s being use for at the time.

However, as Christians, we are never in contact with the spirit world except for the brief occasions when the Holy Spirit allows such contact and we Christians do not and cannot control the power of God. We are simply his servants or vessels of honor, nothing more.

The Lord works through His servants as He chooses, not as we choose. Demons however, only cooperate with humans to give them power when that person wants it, and it is only used as a tool or I’d say a “carrot stick” to draw them even farther away from the Lord and into satanic worship.

Jesus promises the Holy Spirit

The gift of the Holy Spirit empowers us to be strong women of God, even in our moments of weakness. In the bible, Jesus promised his followers, “I will ask the Father, and He will give you another Comforter (Counselor, Helper, Intercessor, Advocate, or Strengthener) that He may remain with you forever; the Spirit of Truth. The world cannot accept him, because it neither sees him nor knows him. But you know him, for he lives with you and will be in you.

The Work of the Holy Spirit (John 15:26-27)

26 “When the Advocate comes, whom I will send to you from the Father—the Spirit of truth who goes out from the Father—he will testify about me. 27 And you also must testify, for you have been with me from the beginning.

16 “All this I have told you so that you will not fall away. They will put you out of the synagogue; in fact, the time is coming when anyone who kills you will think they are offering a service to God. They will do such things because they have not known the Father or me. I have told you this, so that when their time comes you will remember that I warned you about them. I did not tell you this from the beginning because I was with you, but now I am going to him who sent me. None of you asks me, ‘Where are you going?’ Rather, you are filled with grief because I have said these things. But very truly I tell you, it is for your good that I am going away. Unless I go away, the Advocate will not come to you; but if I go, I will send him to you. When he comes, he will prove the world to be in the wrong about sin and righteousness and judgment: about sin, because people do not believe in me; 10 about righteousness, because I am going to the Father, where you can see me no longer; 11 and about judgment, because the prince of this world now stands condemned.

12 “I have much more to say to you, more than you can now bear. 13 But when he, the Spirit of truth, comes, he will guide you into all the truth. He will not speak on his own; he will speak only what he hears, and he will tell you what is yet to come. 14 He will glorify me because it is from me that he will receive what he will make known to you. 15 All that belongs to the Father is mine. That is why I said the Spirit will receive from me what he will make known to you.”

Jesus Prays for His Disciples (John 17:6-19)

“I have revealed you to those whom you gave me out of the world. They were yours; you gave them to me and they have obeyed your word. Now they know that everything you have given me comes from you. For I gave them the words you gave me and they accepted them. They knew with certainty that I came from you, and they believed that you sent me. I pray for them. I am not praying for the world, but for those you have given me, for they are yours. 10 All I have is yours, and all you have is mine. And glory has come to me through them. 11 I will remain in the world no longer, but they are still in the world, and I am coming to you. Holy Father, protect them by the power of your name, the name you gave me, so that they may be one as we are one. 12 While I was with them, I protected them and kept them safe by that name you gave me. None has been lost except the one doomed to destruction so that Scripture would be fulfilled.

13 “I am coming to you now, but I say these things while I am still in the world, so that they may have the full measure of my joy within them. 14 I have given them your word and the world has hated them, for they are not of the world any more than I am of the world. 15 My prayer is not that you take them out of the world but that you protect them from the evil one. 16 They are not of the world, even as I am not of it. 17 Sanctify them by the truth; your word is truth. 18 As you sent me into the world, I have sent them into the world. 19 For them I sanctify myself, that they too may be truly sanctified.

Jesus Prays for All Believers (John 17:20-26)

20 “My prayer is not for them alone. I pray also for those who will believe in me through their message, 21 that all of them may be one, Father, just as you are in me and I am in you. May they also be in us so that the world may believe that you have sent me. 22 I have given them the glory that you gave me, that they may be one as we are one— 23 I in them and you in me—so that they may be brought to complete unity. Then the world will know that you sent me and have loved them even as you have loved me.

24 “Father, I want those you have given me to be with me where I am, and to see my glory, the glory you have given me because you loved me before the creation of the world.

25 “Righteous Father, though the world does not know you, I know you, and they know that you have sent me. 26 I have made you known to them, and will continue to make you known in order that the love you have for me may be in them and that I myself may be in them.”

I pray that as we will continue to be careful in our walk by faith and obedience to our Lord Jesus Christ, we will not allow desires for power to draw us into Satan’s trap.

Let’s talk about trash baby…Let’s talk about you and me (Celebrating Earth Month)

A message to graduates from Woody Allen that was published in the New York Times back in 1979 stated,

 “More than at any other time in history, mankind faces a crossroad. One path leads to despair and utter hopelessness. The other, to total extinction. Let us pray that we have the wisdom to choose correctly.”

I however, strongly believe in being optimistic and that we can create our own path. A path that leads to an enduring place for humankind within the natural systems that sustain us.

This unfortunately won’t be possible until we understand that the rest of the living world matters. Then and only then armed with that knowledge, can we then actually do what it takes to halt our destructive ways, and going forward, treat nature with the proper respect.

What does it take for a planet to be habitable? Researchers have identified three necessary requirements for a planet to sustain life: an ocean and dry land, moderately high levels of carbon dioxide, and long-term climate stability.

Scientists know little about what early Earth was like nearly 4 billion years ago, but they agree that it was a harsh environment different from that of today.

Radiometric Dating Methods

With the use of radiometric dating methods, knowledge of the various rocks found around the world has become more precise.

You may be asking yourself what is radiometric dating as I did?

Well, I was pleasantly surprised to find out that direct methods of dating fossils first became available in the late 1940’s. These methods used naturally occurring isotopes of certain elements found in rocks or fossils to determine their ages and is still used today.

This process is also called absolute dating. Cool!

Scientist have widely accepted radiometric dating as a reliable way to determine the exact ages of rock strata.

The oldest rocks on Earth that have been dated (using isotopes with half-life’s much longer than carbon) include rocks from South Africa, southwestern Greenland, and Minnesota, which are approximately 3.9 billion years old.

Rocks brought back to Earth from the moon have been dated from 3.3 to 4.6 billion years old. These pieces of evidence have led researchers to suggest that the Earth and the moon might have been formed from the same processes at the same time. How intriguing!

Ownership

The notion of “ownership” whether land, air, or sea, has become quite popular and in some legal cases very necessary. It seems a very human thing to do, to own and defend territory and property.  In many articles and books that I have read, even women were considered property back in the day.

Oh really! Let me not even get into that!

The Queen is also very involved in the environment. The Queen Elizabeth II National Trust was formed in 1977, and by 2006 more than 2,300 landowners had registered covenants to protect their land. These sites, covering more than 76,000 hectares, may be bush, wetlands, historic sites or special landscapes.

The Cayman Islands National Trust

The Cayman Islands National Trust is also about protecting the future of the Island’s heritage.

According to the National Trust Law established in 1987, it states, “our purpose is to preserve natural environments and places of historical significance for present and future generations of the Cayman Islands.”

The National Trust protects 9 nature reserves spanning over 3,300 acres of dry forest and mangrove wetlands. The trust owns 12 historic sites from the 1700’s through to the modern era.

There are numerous outreach activities, educational programs and events coordinated by the Trust staff.

Leadership

The Cayman Islands has once again made a deliberate decision to stay under the U.K.’s wing. There has been so much debate regarding Cayman’s Independence and British Crown Dependencies that I had to find out more.

Guess what I found out? British Crown Dependencies, like Jersey and the Isle of Man, can have separate laws as they are not controlled by the British Government but they are the property of the crown. However, British Overseas Territories (BOT) are under the jurisdiction of the United Kingdom but are not a part of it, but they must follow British Laws.

The United Kingdom’s Overseas Territories are spread across the world and span a diverse range of cultures and environments. From the smallest, the tiny island of Pitcairn in the middle of the Pacific Ocean, to the bustling richness of the Cayman Islands in the Caribbean.

The Overseas Territories have separate constitutions with elected governments who are responsible for the day to day administration. They also have a Governor, appointed by HM The Queen whose responsibilities include external affairs, security, defence and air safety.

Recently, we welcomed our new Governor Mr. Martyn Roper to the Cayman Islands.  Mr. Martyn Keith Roper OBE was born 8 June 1965 and is a British diplomat and has been the Governor of the Cayman Islands since October 2018.

Mr. Roper was the Ambassador to Algeria from 2010 to 2014. He was also appointed OBE in 2013 “for services to UK interests in Algeria, particularly the UK response to the Amenas hostage crisis.”

While we may have created this belief that the world “belongs” to us, I think it’s important to note that there is no other species above mankind and that we should have a sense of awareness of the consequences of our actions and note that it could work against our ultimate survival. We need to care not only about the present, but also future generations, and even the fate of other forms of life.

The Cayman Islands Chamber of Commerce will once again carry out its annual Earth Day clean up.

I was also inspired by a quote from Patriarch Bartholomew I, spiritual leader of the world’s 250 million Orthodox Christians. He said,

“For humans to cause species to become extinct and to destroy the biological diversity of God’s creation, for humans to degrade the integrity of the earth by causing changes in its climate, by stripping the earth of its natural forests, or destroying its wetlands, for humans to contaminate the earth’s waters, its land, its air and its life with poisonous substances, these are sins.”

The Ultimate Garbage Disposal

According to The National Geographic book called The World is Blue, how our Fates and the Oceans are One, the term above isn’t quite adequate to describe the dimensions of the great mass of human-made debris found in the ocean.

Of course, people have been throwing things into the ocean-and in heaps and piles on the land too-for as long as there have been people. But now there is approximately seven billion of us generating the kinds of things that do not easily melt into the landscape or seascape.

Plastics

The most abundant, troublesome, persistent and deadly debris is composed of plastic. The term “plastics” may be defined as the wide range of synthetic polymeric materials that are characterized by their deformability and can therefore be molded into a variety of three-dimensional shapes, including a variety of common materials such as polypropylene, polyethylene, polyvinyl chloride, polystyrene, nylon, and polycarbonate.

Overtime plastics have quietly creeped into every facet of human society, seducing us with their multiplicity of uses, their durability, transmutability (Awesome word! It basically means if something is transmuted into a different form, it is changed into that form).

It’s interesting to note, and I also agree that all of human civilization got along perfectly well without plastics for as long as there have been people-up until the past few decades.

However, whether we possess plastic or not is not the problem. The problem is the magnitude of synthetic materials that are used briefly, then thrown away for eternity, thereby permanently changing the nature of the world.

Aiming for Zero Waste

According to Ian D Williams and Tony Curran, Waste Management Research Group, School of Civil Engineering and the Environment, University of Southampton, zero waste is a whole system approach that aims to eliminate rather than ‘manage’ waste.

As well as encouraging waste diversion from landfill and incineration, it is a guiding design philosophy for eliminating waste at source and at all points down the supply chain. It shifts from the current one-way linear resource use and disposal culture to a ‘closed-loop’ circular system modelled on Nature’s successful strategies

The zero-waste approach envisions all industrial inputs being used in final products or converted into value-added inputs for other industries or processes. In this way, industries will be reorganized into clusters such that each industry’s wastes/by-products are fully matched with the input requirements of another industry, and the integrated whole produces no waste.

From an environmental perspective, the elimination of waste represents the ultimate solution to pollution problems that threaten ecosystems at global, national and local levels. In addition, full use of raw materials, accompanied by a shift towards renewable sources, means that utilization of the Earth’s resources can be brought back to sustainable levels.

For business, zero waste can mean greater competitiveness and represents a continuation of its inevitable drive towards efficiency. First came productivity of labor and capital, and now comes the productivity of raw materials – producing more from less. Zero waste in industrial networks can therefore be understood as a new standard for efficiency and integration.

The Good Samaritan Food Bank

With approximately seven billion people to feed on a planet that stubbornly remains the same size, we seriously need to avoid waste. And that’s what we have decided to tackle right here in the Cayman Islands.

The Good Samaritan Food Bank is the first organization in the Cayman Islands to mitigate island-wide hunger, malnutrition and poverty by providing access to good, healthy food through gathering and distributing food donations to non-profit organizations and various food counters serving the critical needs of the community.

The Food Bank was founded by two local businessmen: Woody Foster and Reginald “Choppy” Delapenha, along with the priceless but humble consultative support of experienced food bank operator, Rev. Charles Boucher.

Woody Foster was reared with a good sense and value for food and community, which can be attributed to him seeing his father and uncle’s hard work and dedication to the local grocery industry and community from an early age. Woody later joined them in the family grocery business where he worked diligently in every aspect of the business.

Woody is passionate about his community and developing a systematic approach utilizing the grocery industry to alleviate hunger in both the near and long- terms and looks forward to an active role in the success of Cayman’s first Food Bank.

Rev. Charles Boucher and his wife Manon Papillon have dedicated their lives to helping others. In 1984 Rev. Boucher started his first church and has since served in integral roles within church communities throughout Quebec and Montreal, Canada – and most recently here in Grand Cayman – where he co-pastors at the First Assembly of God.

Rev. Boucher has successfully started or played a paramount role in several accomplished organizations to help those in need including two drug rehabilitative centers and three Food Banks – one of which his wife Manon served as founding member – The Action Nouvelle Vie, also known as the largest food bank on the south shore of Montreal, serving more than 3,000 people weekly and bi-weekly. Manon was also an active member of the Canadian Food Bank Association.  Rev. Marie Eden studied Human & Social Services earning a Bachelor of Science degree and has paralegal certification.   Marie serves on the board of directors of one the Island’s busiest food pantries.  With over 20 years of experience with programs which assist persons in the community she has experienced first-hand the increasing number of families in need.  

Marie looks forward to being part of the first central food bank in the Cayman Islands which will not only have the capability of alleviating food waste, but also of monitoring the distribution of food to effectively benefit those persons most in need.

Colonel Phillip Hyre is a former Police Officer and previous Commander of the Cayman Islands Cadet Corps. He has served as one of the founding members as President of the Water for Life Now Ministry, a non-profit organization that caters to the needs of homeless men and women in the United States of America. In 2016 he was the recipient of the prestigious Extraordinary People Awards, Philanthropist of the year. He has a master’s degree in youth management and development through City and Guilds Institute of London and is presently pursuing a Doctoral degree from Centre for Theological Leadership Training, Cayman Islands.

Speaking of Good Samaritan, the Good Samaritan is one of the most famous parables told by Jesus. It is recounted in the Gospel of Luke and defines a standard of love toward which Jesus wished his followers to aspire.

A lawyer asked Jesus how to be saved. Jesus asked in reply, “What is written in the Torah?” The lawyer recounted the Torah sayings of “Love God” and “Love thy neighbor.”

In the parable, Jesus told of a traveler who is attacked, robbed, and left on the side of a road. A priest passes by, but he avoids the man due to his disheveled appearance. Next, a Levite, a member of another revered sect, passes and ignores the stricken man as well.

Finally; a Samaritan passed along the way. Samaritans were an ostracized and hated ethnicity at the time. According to the story, the Samaritan is the only one who decides to help by clothing, sheltering, and feeding the victim.

This is an excellent example of how Jesus often shocked his audience to get his point across. The celebration of a Samaritan would have caused astonishment at the time, But I believe this only emphasizes the importance of aiding people in need and the closeness of all humankind.

Good Samaritan Laws

I was also pleased to learn that there are also Good Samaritan Laws which exist in many countries today.

Good Samaritan laws generally provide basic legal protection for those who assist a person who is injured or in danger. In essence, these laws protect the “Good Samaritan” from liability if unintended consequences result from their assistance.

Agriculture

A thousand years ago, everything in Europe depended on agriculture. From Britain and Ireland to central Europe, 80 to 90 percent of the population struggled to make a living from the soil.

Everyone, even the greatest lord, depended on a countryside farmed without machines, hybrid seed or fertilizers. Horses and oxen, even the women, hauled the plow and the harrow. Wow!

The harvest was gathered by hand, carried on peoples backs, or maybe even transported by what I’ve come to find out was called oxcart or the river barge to market.

Every farmer knew that coarse land had to be grazed and manured by animals, then rested to regain its fertility and minimize plant disease.

According to Brian M. Fagan, (The Great Warming: Climate Change and the Rise and Fall of Civilizations-1st U.S. ed. P. cm.), medieval European peasants knew the properties of different grazing grasses, the slight indicators of renewed soil fertility and the seasons of wild plant foods. I guess we could compare them to modern-day survival farmers in Africa.

Most farmers had a few head of livestock- a milk cow or two, some pigs, sheep, goats and chickens and if they were fortunate enough, a horse and maybe some oxen

He also stated that trying to make a living from Europe’s medieval soils was never easy but it could be done.  Farmers in England and France grew mainly wheat, barley and oats and everyone grew vegetables.

The Cayman Islands Agricultural Show

During the month of March, the Cayman Islands will once again celebrate its annual Agricultural Show. It’s a family fun event showcasing the Island’s best animals, produce and food. There will also be activities for all the family to enjoy.

Now fast-forward with me to the 21st century where advances in modern farming technology have dramatically increased crop yields.

Agricultural experts state that most farmers use synthetic pesticides to protect their crops and may use synthetic fertilizers to boost growth. Other farmers, however, cultivate “organic foods”, those grown without the use of synthetic pesticides and fertilizers.

Bird Pepper (Capsicum baccatum, Solanum Family)

There are a great many cultivated forms of these capsicum peppers as I have come to find out, and most of them are very hot to the taste.

The Bird Pepper shown above, with its pretty, glossy green to scarlet fruits, is widespread in the tropics, and is most common in Jamaica as a lovely doorway plant. Occasionally, it is found in ‘the wild’ from bird-dropped seeds.

They are extensively used in Jamaican cuisines, imparting a most pleasant flavor as well as their strong and spicy heat. They are often allowed to stand in sherry or vinegar for an interesting and breathtaking condiment. (Nice!)


Susumber, Gully Bean, Turkey Berry (Solanum torvum, Solanum Family)

Guess what else I found out? The Gully Bean or any of the names mentioned above is found in almost all parts of the world’s tropics and this shrub on occasion can reach a height of up to ten feet or more. Its most recognized in waste places and forest clearings with its big bold foliage, circular berries and rather pretty flowers which enhances its natural beauty.

The young shoots of this Solanum are eaten in Indonesia as a cooked vegetable, but the half-ripe green berries are considered edible only in Jamaica, where they are prized for their refreshingly bitter flavor. They are often served mixed with fish at breakfast.

Cell Culture Techniques

Another major breakthrough in the 21st century is the development of cell culture techniques. Using these techniques, scientists have been able to remove individual cells from a parent plant and grow these cells into new individuals. Wow!

Using the cell culture techniques, horticulturalists are able to produce virtually unlimited numbers of genetically identical offspring. These techniques have been particularly useful in producing plants that are slow to multiply on their own. For example, award-winning varieties of orchids are produced in this way.

The Garden Club of Grand Cayman

Speaking of award-winning, did you know The Garden Club of Grand Caymanhas been presenting a Standard Flower Show every year?

Well, I was honored to participate in their 60th Anniversary Celebration back in 2017 and learnt an array of floral arrangement techniques and classifications.

The Garden Club of Grand Cayman was founded in April 16th 1957 and has been presenting flower shows to the public since 1961. It is held at the South Sound Community Center in George Town.

The Garden Club aims to promote interest in and knowledge of gardening and all things related to the enjoyment of the natural beauty of the Cayman Islands.

To undertake projects, for themselves or in concert with others, to beautify and support the community.

They also wish to encourage the promotion of friendship and understanding among people of all races and nationalities who share their interest in gardening.

Did you also know that cell culture is also used for the commercial production of a tremendous number of plants in a short period of time-such as the chrysanthemums you may buy at the grocery store?

And while we are on the subject of grocery stores- In another article I’ve written called, “Let’s talk about trash baby…lets talk about you and me”I also touch on other needs for sustainability and why we need to avoid waste when possible.

Plants and Medicine

Plants also provide a wide array of chemicals, many of which have medicinal effects on humans.

For thousands of years, people relied heavily on extracts made from the leaves, stems and barks, roots, and other parts of plants to treat illnesses, and some still do.

Today, many countries like Korea, China and Japan use botanical products in an attempt to prevent or alleviate a variety of common health problems, including colds, fatigue, depression, and even memory loss.

According to my research, useful drugs have also been developed from plants. For example, Reserpine, which is a drug used to treat hypertension, is produced from Indian snakeroot (Rauwolfia serpentina). Or extracts of rosy periwinkle (Catharanthus roseus) which have been used in two cancer fighting drugs. Wow!

It’s obvious that with all the research being done, it’s evident that scientist believe that genetic engineering techniques may revolutionize worldwide agriculture and health!

Replicas: 7th Heaven: Backing Sand-Banking our Future

One of the most dazzling sights in the Cayman Islands is the radiance of a sand yard, usually found surrounding a Caymanian Cottage and featuring white sand, neatly tamped down and sprinkled with various isolated plants, adorned with conch shells and bordered by picket fences.

Currently my home celebrates such an exquisite feature which was not easy to create.

Have you ever actual tried carrying the sand from the beach? Believe me, it is not as glamourous as the final results. But it was worth it!

The Caymanian sand yard has become one of the many symbols of the landscape and there’s an earlier tradition known by many Caymanians of “backing sand” which was done with baskets to add new white sand to brighten the existing sandy areas at Christmas time.

Some believed the sand yard idea was brought here by African slaves who would have been familiar with the practice in their homeland. Others say it was initiated by the early British settlers since the white sand was reminiscent of the snow from their country. Very interesting concept.

However, whatever the origin, sand yards can still be seen in the Cayman Islands, including my front yard, along with the sizzling beauty of our gloriously famous 7 Mile Beach!

Nevertheless, that was then, this is now the year 2019. Perhaps they were backing sand then, but I strongly believe we need to not only back our future as adults but we MUST back our children’s future now! Some of them may even turn out to be a neuroscientist someday!

I personally believe that and have committed my time to doing my part as a mentor for a few years now at the John Gray High School and will continue to mentor and guide as many young Caymanians as I can.

I also find joy in sharing with my readers any information that I find to be useful or simply entertaining. I know I enjoy reading other people’s articles.

You are probably familiar with the term’s “introvert” and “extrovert,” and you may even identify yourself as one or the other, but sometimes people are not aware of the actual meaning of each.

According to Meyers & Briggs, the terms introversion and extroversion were originally coined by the founder of analytical psychology, Carl Jung, to describe the way in which a person finds energy.

Extroverts tend to recharge by looking outside of themselves, with other people and external activities, while introverts tend to recharge within themselves, through their thoughts and time spent alone.

People experience moments of both extroversion and introversion, but have a tendency to lean towards one or the other. You could also be somewhere in-between, a term known as an ambivert.

According to an article I read in the Caymanian Compass a few years ago, the term ambivert was first used by social scientists in the 1920’s to describe someone who is neither exceptionally introverted nor exceptionally extroverted.

Did you know that communication between introverts and extroverts can sometimes lead to misunderstandings?

For example, introverts are commonly seen as shy simply because they are quiet.
The reality is that introverts may just be thinking to themselves and are content being quiet.

Shyness, on the other hand, is an apprehensive feeling. A shy person does not want to be quiet. Of course, a person can be both introverted and shy, but the two are not synonymous with one another.

Knowing whether you are an introvert, extrovert, or somewhere in-between can help you to understand your own reactions and others’ reactions to certain situations in life. Accept yourself and others, and appreciate the perspectives that both introverts and extroverts bring to the table.

Ironically studies have shown that there are benefits to connecting. Our personal growth and evolution came about as a result of connecting with our fellow humans. I can definitely think of a few human connections that I found to be quite pleasurable. Lol!

When you make new connections in the inside world- in your brain that is, this keeps you young and alert.

According to Dr. Lisa Berkman of the Harvard School of Health Sciences; she and her team carefully looked at 7,000 people aged 35 to 65, over a period of ten years.

Their study concluded that people who lack social and community ties are almost three times more likely to die of medical illness than those who have more extensive contacts. An all this is independent of Socioeconomic status and health practices such as smoking, alcoholic beverage consumption, obesity or physical activity.

I’m sorry to rain on her parade but I don’t necessarily agree with that and I bind that in the name of JESUS! Sometimes God may need you to separate yourself to recuperate.

For how long? However long it takes to heal- you do that!

On a brighter and more innovative note, below is some very useful information from Harvard:

Harvard’s endowment is a dedicated and permanent source of funding that maintains the teaching and research mission of the University. Made up of more than 13,000 individual funds invested as a single entity, the endowment’s returns have enabled leading financial aid programs, groundbreaking discoveries in scientific research, and hundreds of professorships across a wide range of academic fields.

However, there is a common misconception that endowments, including Harvard’s, can be accessed like bank accounts, used for anything at any time as long as funds are available.

In reality, Harvard’s flexibility in spending from the endowment is limited by the fact that it must be maintained in perpetuity and that it is largely restricted.

I learnt that endowment gifts are intended by their donors to benefit both current and future generations of students and scholars. As a result, Harvard is obligated to preserve the purchasing power of these gifts by spending only a small fraction of their value each year.

Spending significantly more than that over time, for whatever reason, would privilege the present over the future in a manner inconsistent with an endowment’s fundamental purpose of maintaining intergenerational equity. ACADEMIC REQUIREMENTS

The school has a 5% acceptance rate. Last year, 2,037 out of 39,506 applicants were admitted making Harvard an extremely competitive school to get into with a very low chance of acceptance – even for applicants with the highest scores and grades.

Academically, it has exceptionally high requirements for admission test scores, generally admitting students who score in the top 2 percent. Harvard University typically accepts and attracts “A” average high school students. Of those applicants who were admitted, 83% chose to enroll. This indicates that admission to the school is highly desirable and it may be a primary choice for many students.

Now let’s get back to community connections. We know that other people can also take care of your needs and desires and I can think of many situations, but for me, ultimately Jesus Christ holds first place in my life, sorry, and then everybody else. Lol!

Like I said, some people can fill certain needs in your life- needs like romance, friendship, a dream job, assistance in the church, assistance in school, assistance on the job, help with family, help with the community etc.

Chances are you will need someone’s help and they might need yours to get certain needs and desires met. Therefore, I believe most of the time, connecting is good for the community. Especially if it is done in a healthy way!

After all a community is the culmination of a lot of connections, common beliefs, achievements, values, interest and geography. Rome wasn’t built in a day and neither were the Cayman Islands.

As I stated in my previous article, (Discover the Yellow or “Blues” in You: Royal Labor Pains), The Cayman Islands was discovered by Christopher Columbus in 1503. And since the early settlors, there have been British in the 1670’s, our dependency of Jamaica back in 1863 and many Governmental changes.

Jamaica’s Fascinating History

Speaking of Jamaica’s rich history. Every third Monday of October is National Heroes Day in Jamaica. This public holiday is dedicated to the memory of Jamaica’s seven official national heroes.

This year Monday, it will be on the 21st October 2019.On National Heroes Day, six heroes and one heroine will still be remembered for their heroic deeds that led to greater freedom and economic growth and prosperity for their homeland.One of our heroes was a man by the name of Paul Bogle.

Paul Bogle, a Baptist Deacon was generally regarded as a peaceful man who shunned violence. He believed in the teachings of the Bible, endorsing the principles of charity and endurance.

Yet he was also a leader and organizer who knew well the terrains of the land and had spent time in educating and training his followers. He lived in St. Thomas and led the Morant Bay Rebellion in 1865.Cool!

George William Gordon was a free colored land owner and an associate of Bogle.

As a member of the House of Parliament, he used his position to highlight the sufferings of the people and to make a plea for changes.The Morant Bay Rebellion and the resultant deaths of Bogle and Gordon precipitated the beginning of a new era in Jamaica’s development.

The British government became compelled to make changes including outstanding reforms in education, health, local government, banking and infrastructure.

Once again, let’s get back to community connections because although connecting is good, so are boundaries. Everyone should have boundaries. Our boundaries not only help to safeguard us and our family and friends when we may want to share quality time but it also helps us to manage our time and emotional energy.

I read another article many years ago where Benjamin Franklin describes “a perfect day” as “eight hours of work, eight hours of play, and eight hours of rest”. You have also probably heard of Einstein’s famous equation E=MC2. Apparently, the most important thing to harness is emotional energy.

Emotional Energy

It powers our mental ability to do work, to create, to calculate, to tell stories, to learn, and to grow. It also powers our friendships and our very capacity to love. Studies state that when we think of the positive emotional energy that exists in our relationships, what we’re really referring to is our self-esteem.

Every relationship “system” has a degree and quality of self-esteem to it, both contributed by individuals and as a collective whole.

There are families or even church congregation with high self-esteem and low self-esteem, corporations and universities with high self-esteem we might call it “morale” and low self-esteem, and married couples who combined have high self-esteem or low self-esteem.These levels of self-esteem correspond to the levels of positive human emotional energy present.

In physics, there are two general kinds of energy: potential energy stored in stationary, you might even say soothing or calm form (like petroleum oil), and kinetic energy that is actively spent to do work (like gasoline).

The positive emotional energy metaphorically stored in the mammalian brain also takes two forms: nurturing (or motherly) emotional energy, which is like the oil of the mind, and action-prone (or fatherly) emotional energy, which is like the gasoline of the mind. Ultimately my self-esteem is rooted and grounded in Christ!

Through Him, I have steadily been able to garner my inner strength-leaning and depending on Him, the “only one” who clearly and consistently has the power and wants to guide humanity into heaven.

So, I guess now is the time when I ask my readers, if you died today, are you sure you would make it into heaven?What would you say if God were to ask you, “Why should I allow you into heaven?”

I know you would want to be confident that you had the right answers to those two important questions.God promises eternal life for those who accept his son. John 3:16 states,

“For God so loved the world that he gave His only begotten son, so that whoever believes in Him shall not perish but shall have everlasting life”.

So, whether we were backing sand to brighten the traditional Caymanian yards of the past or banking and investing for our future, let’s make sure to back our future and our children’s future for our place in heaven!

Recent changes to the Cayman Islands Proceeds of Crime Law, 2017 (POCL) has clarified that persons conducting relevant financial business, whether a non-profit or an unregulated investment fund vehicle, are now required to appoint an MLRO, and an alternate, and to have a AML/CFT compliance program in place.

The Cayman Islands Monetary Authority has already been paying keen attention to the suitability of MLROs appointed by its licensees, recommending changes where it considers there is a need.

It is anticipated that the Department for Commerce and Investments will ultimately do the same, once its enforcement powers over certain members of the Designated Non-Financial Businesses and Professions and Non-Profit sector, is enlisted.

PROMOTING INNOVATION THROUGH EDUCATION: THE BLOCKCHAIN INDUSTRY, LAW ENFORCEMENT AND REGULATORS WORK TOWARDS A COMMON GOAL

Under section 136 of the POCL, a person commits an offense if he does not make the “required disclosure” to the FRA or his MLRO or deputy, of a suspicion or actual knowledge of terrorist financing or money laundering that has come to his attention in the course of doing relevant financial business.

Section 137 of the POCL, also sets out the circumstances in which an MLRO commits an offense for failures to make appropriate disclosures. At the serious end of the stick, persons (including your MLRO) could find him or herself imprisoned for five years so there are real consequences.

Virtual Currency, The Blockchain Innovative Technology and its Regulation, Smart Contracts and Digital Assets

There are three “powers” connected to every job. Regardless of the tasks performed and level of authority, these three elements are evident.

1. Skill Power- the talent and ability to do the job
2. Knowledge Power-experience and know-how
3. Position Power-The influence attached to a job or position

SKILL AND KNOWLEDGE POWER

For some people, skill and knowledge powers create barriers in their communications and relationships with others. Some brilliant minds of technicians, scientists, chief economist and engineers clearly understand the world of bytes, megabytes, semiconductors, biotechnology, telecoms, blockchain innovations and artificial intelligence where I was a total stranger. Lol!  But not anymore!

VIRTUAL CURRENCY DEFINITION

The Massachusetts Securities Division has consistently referred to the Financial Action Task Force (FATF) report titled Virtual Currencies, Key Definitions and Potential AML/CFT Risks, to define “virtual currency” and “cryptocurrency”, which they refer to interchangeably, as follows:

“Virtual currency is a digital representation of value that can be digitally traded and functions as (1) a medium of exchange; and/or (2) a unit of account; and/or (3) a store of value, but does not have legal tender status (i.e., when tendered to a creditor, is a valid and legal offer of payment) in any jurisdiction.

It is not issued nor guaranteed by any jurisdiction, and fulfills the above functions only by agreement within the community of users of the virtual currency.

Virtual currency is distinguished from fiat currency (a.k.a. “real currency”, “real money”, or “national currency”), which is the coin and paper money of a country that is designated as its legal tender; circulates; and is customarily used and accepted as a medium of exchange in the issuing country.

Please note however that the above description is only one of several definitions. How regulators define virtual currencies will continue to evolve as the regulatory landscape in this area gains clarity.

THE REGULATION OF BLOCKCHAIN TECHNOLOGY (A FINE LINE BETWEEN “PROTECTION” AND “BIG BROTHER, BIG SISTER APPROACH”)

Regulation is necessary, but avoiding over-regulation is crucial. The risk for over-regulation are huge, especially when we take a look back at the recent history of regulation.

According to Joseph F. Borg & Tessa Schembri, WH Partners, Europe is notorious when it comes to over-regulation. They state that while it is undeniable that these regulations are backed by good intentions, the reality is that many recent European Union directives and regulations are bad for business: they cripple star-ups and limit innovation.

They also continue to emphasis that it is important to strike the right balance and maintain the focus on the regulatory objectives, which in the case of blockchain technology should be as follows:

1. The creation of standards that allow interoperability and protect end users;
2. Ensures the protection of vulnerable people and protecting them from criminals; and
3. Ensures good governance to protect investors as well as end users from fraud, mismanagement and gross negligence.

The best solution for protection, which I also agree with, is ensuring transparency and providing the necessary information for an adult to be able to make his/her own decision.

POSITION POWER

With position power, some people rule over those in lower levels of authority. Top executives or managers might show disrespect or favoritism while others might display arrogant behaviors to appear superior.

Please note however that this is not true for every person in a position of power.
However, we can’t deny that power plays are common in today’s society.

But there is one power I personally believe is greater that all powers and I believe with the Holy Spirit’s guidance, He is essential to be effective in any job- God’s power!

We should always pray and ask God to erect a “hedge of protection” around us as we go through our daily lives in whatever capacity we are given. His protection however does not mean you will be void of sin in your personal life or the struggles we all encounter in our professional careers.

I believe however that God’s power in our life will always check us when we’re tempted to abuse our skills, knowledge and position powers. Especially if it affects the lives of His beloved people. When we depend on Him for protection, the allure of temptation is diverted, removed or eliminated.

I believe our prayer should be for God to free us and keep us from temptations of pride, envy, lying, lust, greed and countless other sins each day. Believe me I pray on this every day because after all I’m only human and being human is an instant qualifier for many of the temptations I stated above.

THE CUSTODY OF DIGITAL ASSETS (UTILITY TOKENS)

The growing fascination with digital assets, including cryptocurrencies (a.k.a. digital currency or virtual currency) and tokens, presents legal and operational challenges to investors, entrepreneurs and service providers, not to mention the regulators who oversee them.

“Utility tokens” refer to coins or tokens that serve a particular (non-incidental) function, or give the holder rights or access to goods, licenses or services. A common form of utility token may give the holder the right to use a computer program that provides a kind of service for a defined period of time. Jay G. Baris of Shearman & Sterling LLP states that some refer to utility tokens as “app coins”, “app tokens”, or “utility coins”.
Some utility tokens may be securities, others are not.

What is “custody”?

Rule 206(4)-2 under the Advisers Act defines custody to mean “holding, directly or indirectly, client funds or securities, or having any authority to obtain possession of them”.

The regulation provides that you have custody of an asset “if a related person holds, directly or indirectly, client funds or securities, or has any authority to obtain possession of them, in connection with advisory services you provide to clients”.

Rule 206-4(2) defines custody of an asset to include:

• Possession of client funds or securities;
• Any arrangement (including a general power of attorney) under which you are authorized or permitted to withdraw client funds or securities maintained with a custodian upon your instruction to the custodian; and
• Any capacity (such as a general partner of a limited partnership, managing member of a limited liability company or a comparable position for another type of pooled investment vehicle, or trustee of a trust) that gibes you or your supervised person legal ownership of or access to client funds or securities.

What law applies?

To determine what law applies, we must look at the nature of the person or entity that holds or proposes to hold a digital asset.

The holder of a digital asset can be:

• A natural person, directly or in a managed account;
• A pooled investment vehicle that is not publicly offered in the U.S., such as a hedge fund, private equity fund, or other private fund;
• A pooled vehicle that is registered as an investment company;
• A regulated entity such as a broker-dealer, bank or investment adviser;
• An operating company; or
• Other pooled investment vehicles which might be commodity pools that otherwise would be investment companies but for an exemption under the 1940 Act.

THE LEGISLATIVE HISTORY OF THE INVESTMENT COMPANY ACT OF 1940 (THE ICA) AND ITS COMPANION STATUTE, THE INVESTMENT ADVISERS ACT OF 1940 (THE ADVISERS ACT)

The safeguarding of client assets has long been a priority of Congress and the Securities and Exchange Commission (the SEC). According to my research, Congress was clearly concerned with the potential for abuses or misappropriation of client assets held in investment trusts and managed by investment advisers:

That investors in investment trusts and investment companies are subject to substantial losses at the hands of unscrupulous persons is obvious from the very nature of the assets of such companies. Their assets consist almost invariably of cash and marketable securities. They are liquid, mobile, and easily negotiable.

These assets can be easily misappropriated, ‘looted’ or otherwise misused for the selfish purposes of those in control of these enterprises. In the absence of regulating legislation, individuals who lack integrity will continue to be attracted by the opportunity available for personal profit in the control of the liquid assets of investment trusts and investment companies.

BERNARD L. MADOFF MASSIVE PONZI SCHEME

As I researched further, I came across the Bernard L. Madoff massive Ponzi scheme in which he convinced his clients that they owned securities that did not exist. For years, he evaded regulatory scrutiny until the scheme began to unravel. This scandal prompted the SEC to take actions to reduce the chance that a Madoff-style fraud would occur or go undetected in the future.

For investment advisers who can control their clients’ assets, the rule requires enhanced procedures, such as surprise asset-counts, third-party reviews and audited financial statements.

It is interesting to note however, when the U.S. Congress enacted the ICA and the Advisers Act, it clearly did not contemplate, or even dreamed of, how the law would apply to digital assets such as cryptocurrencies (virtual or digital currencies) or utility tokens.

However, the basic concerns of preventing fraud or misappropriation are just as valid today as they were in 1940. The only difference is that we are now attempting to apply 80-year-old laws designed to protect assets consisting of cash and securities to an entirely new class of digital assets created by a technology that did not exist at the time the laws were written.

SMART CONTRACT

The term “smart contracts” can be misleading especially for lawyers who have a definite idea of what must be shown for there to be a binding legal agreement between parties.
At a minimum, a contract requires there to be an offer by one party, an acceptance by another party, and some form of consideration to exist.

When the term is used by software engineers, it means computer code that is self-executing (the type of code will depend on the protocol on which the code is implemented).

The term “smart legal agreements” has been used to describe a hybrid legal contract, and this combination of a legal agreement with a smart contract would be most useful for financial instruments.

If we were to envision how the LSTA (Loan Syndications and Trading Association) confirm could become a smart legal agreement with certain provisions remaining in human prose; for example, the reference to LSTA Arbitration Rules could remain as text while provisions relating to the calculation of the loan purchase price could be coded and thus become self-executing.

There is risk of error or corruption when utilizing smart legal agreements and the management of information that is drawn from an external source referred to as an “oracle” in the blockchain nomenclature. Because smart contracts are programmed to be self-executing, some information may need to be pulled in from an external source, and therefore it is essential that this information from the oracle be accurate.

Smart contracts build on the innovation of blockchain technology and have the potential to allow parties to structure and carry out transactions in a more efficient and secure manner than traditional contracts; however, there are still challenges and obstacles that must be overcome before smart legal agreements become commonplace.

When God said, “Let there be Light!”, the creation of the universe began according to the book of Genesis.

The light of the Sun gives life to our world.

We can even go a step further and look into photosynthesis.

PHOTOSYNTHESIS

Photosynthesis if we remember from High School, it is when certain organisms make their own food by capturing energy from the sun. For example, organisms like trees and grass are called producers and during photosynthesis they convert the energy in sunlight into chemical energy by locking it within the bond of the food molecules they synthesize.

There is also artificial lighting which of course does not even come close to the broad spectrum of sunlight and is definitely not close to its brightness.

Fluorescent light emit light in much narrower wavelengths, since they glow from the light given off by specific atomic elements, which apparently is usually mercury or sodium.

It is also no secret that lovers love candlelight.

Not only is it more romantic than electric lightning, the soft, yellowish, orange glow of candlelight seemingly makes your skin tone appear softer, smoother and warmer. Infinitely 120% more touchable.

Think about it! The light of fire is the basis of all human civilization. The metaphors of light and vision are so fundamental that we use them in our everyday language.

For instance, we say, seeing is believing, and seeing is so important to us.
So necessary in fact that many of us find ourselves wearing an assortment of eyeglasses or spectacles to compensate for our blurred vision.

EYEGLASSES

The earliest “eyeglasses” were made of gemstones worn by the emperor Nero.

People even began using glass lenses in the Middle Ages to help them focus their vision so that they could read better.

Eyeglasses, or spectacles, have been in use in both Europe and China since approximately the thirteenth century. Certainly, the travels of Marco Polo and the other traders played a role in the exchange. However, we not only see, we look, behold, observe, scrutinize, study, stare, examine etc.

Light is the difference between life and death. It has shaped our world and shaped us. I also believe that vision is a gift and is the most important of our five senses.

Speaking of light-Nothing in the universe travels faster than light. When someone tells you that you run nearly as fast as the speed of light or even as fast as a speeding bullet, you know your fast!

In the incredible vacuum of space, light travels at a velocity of approximately 186,000 miles per second; this is the universe ideal speed limit.

I was also fascinated to find out that even specialist and experts at places like MIT and Caltech have been seen wearing T-Shirts which state:

Suicide and Mental Health

A number of student deaths in the late 1990s and early 2000s resulted in considerable media attention to MIT’s culture and student life. After the alcohol-related death of Scott Krueger in September 1997 as a new member at the Phi Gamma Delta fraternity, MIT began requiring all freshmen to live in the dormitory system.

The 2000 suicide of MIT undergraduate Elizabeth Shin drew attention to suicides at MIT and created a controversy over whether MIT had an unusually high suicide rate. In late 2001 a task force’s recommended improvements in student mental health services were implemented, including expanding staff and operating hours at the mental health center.

These and later cases were significant as well because they sought to prove the negligence and liability of university administrators.

So clearly from all the information gathered, we’ve got experts and specialist at MIT doing their research on many topics, but recently I was reading about EMIT (Enzyme-multiplied immunoassay technique).

EMIT (Enzyme-Multiplied Immunoassay Technique)

These are test that use various DNA techniques to amplify trace chemicals in urine. Apparently, it has become the standard approach for screening large amounts of urine samples.

According to my most resent findings, in 1986 the National Collegiate Athletic Association (NCAA) instituted mandatory drug screening of student athletes.

Eventually many colleges and universities implemented their own drug testing policies.
In addition to its use in collegiate sports, drug testing is conducted in professional and Olympic sports as well as in the work place.

EMIT can be used in a robot tester that employs a light sensor to read urine samples and prints out a value for each of five or six drugs present, it can process 18,000 samples an hour. Wow!

The detection period depends on the type and dose of the drug. EMIT is more than 98% accurate, with error biased towards nondetection.

I also learnt that because EMIT responds to a broad range of opiate and amphetamine compounds, it sometimes produces a positive result for harmless prescription drugs such as herbal teas and poppy seeds.

In the 2001 Movie, The One, Gabriel Yulaw (Jet Li), once an officer of the “Multiverse Authority, an agency that polices interdimensional travel via wormholes, seeks to hunt down all variations of himself in alternate universes.


By killing all 124 of his other selves (thus becoming the last version) and absorbing their life energies which was making him stronger, faster and increasing his mental abilities, he believes he will become an immortal godlike being call “The One”.

I love movies and plays, but did you know that play takes many forms and promotes cognitive development in many ways?

Play, according to Jean Piaget, is a child’s work.

Children often use play to learn about their physical surroundings and use dramatic play to master symbolic representation and increase their social knowledge, thereby reducing their self-centered orientation.

By engaging in constructive play, children acquire bits of information that they use to build their knowledge.

Greater knowledge, in turn gives them increasingly higher levels of understanding and competence.

In addition, through active play, children develop skills that make them feel physically confident and self-assured.

An example of a kind of play are games and competitive play.

This kind of play involves cooperation with others and with following rules that define appropriate behavior.

This also contributes to the development of learning rules, understanding cause-and-effect and consequences of various actions as well as winning and losing.

In the movie, Yulaw is very competitive and is clearly what we would call an ‘Alpha male’, very dominant and wants to be the Chief, the Leader, the King, the Ruler, or as the movie states The One!

Whilst there’s nothing wrong with wanting to be a leader, we must be cognizant of the way we choose to acquire such status.

For instance, Yulaw’s crave for power was only being acquired so that he could become a godlike immortal being dominating the multiverse at his pleasure.

He wasn’t seeking to use it for good and he definitely wasn’t obtaining his power in an honorable way.


Speaking of power and law- In the bible, God showed great restraint dealing with sin from the days of Adam until the days of Noah.

He operated in mercy, love, and forgiveness. But in the end, sin multiplied so grievously before the Flood that after the Flood, God handed down the Law of Moses.

However according to my studies, the Old Testament is not an exact representation of God and only serves to bring condemnation and give strength to sin.

The Old Covenant was an inferior covenant to the New Covenant and the whole book of Hebrews addresses this concept in details.

Have you ever felt guilty?

Do you know where that came from?

You got that through the Law, through the Old Testament administration.

The Law make you feel guilty. It condemns you, according to 2 Corinthians 3:9 and Romans 3:19

Condemnation is not to be confused with the conviction of the Holy Spirit.

He is on the inside of you and will let you know immediately if what you are thinking of doing or have done is sin or not God’s will for your life.

Conviction draws you to God and leads you in His ways.

Condemnation drives you away from intimacy with God and makes you feel helpless to do anything but sin.

The bible says the purpose of the Law was to give us the knowledge of sin. Lightning wasn’t striking people every time they committed sin.

At the time, what seemed to be a lack of seriousness toward sin had and still have people thinking, Well I know I should be better, so I’m going to make a New Year’s Resolution and not beat my wife anymore or cheat on her. Or I’m going to stop drinking or doing drugs.

They would temporarily improve their lives and start trusting in their own goodness.

However, they still aren’t considering the seriousness of the sin they have in their lives.
Without the Law, mankind began to think, Well, just do the best you can and God’s going to accept you.

They didn’t understand how deadly sin was because God hadn’t punished it.

So, God began to reveal His true wrath on sin by giving the Law.

Suddenly people realized what they had thought was right and wrong was totally off base.

Their conscience had been defiled and deaden, so God had to help them realize what right and wrong really were.

The Law revived their consciences.

The correct purpose of the Law is to give revelation to people who do not see the need for God.

People who do not understand they have sinned against God and have deceived themselves.

2 Thessalonians Chapter 2

The Man of Lawlessness

1 Concerning the coming of our Lord Jesus Christ and our being gathered to him, we ask you, brothers and sisters,

2 not to become easily unsettled or alarmed by the teaching allegedly from us—whether by a prophecy or by word of mouth or by letter—asserting that the day of the Lord has already come.

3 Don’t let anyone deceive you in any way, for that day will not come until the rebellion occurs and the man of lawlessness is revealed, the man doomed to destruction.

4 He will oppose and will exalt himself over everything that is called God or is worshiped, so that he sets himself up in God’s temple, proclaiming himself to be God.

In verse 4, we can say that this person believes they’re a God. A person deserving of people’s worship. However, an idol is any person, object or activity you give a higher priority in your life than a relationship with God.

An idol can be your home, your job, a vehicle, a relationship, or even your family. An idol can be a pet, a computer, or what you look at on that computer. An idol can be alcohol, drugs, sex, or any sin.

An idol can be the work you do for the Lord that consumes all your energy and time. God says He’s a jealous God. He wants our time and attention.

And verse 5 continues to tell us what Paul continues to encourage us by saying,

5 Don’t you remember that when I was with you, I used to tell you these things?

6 And now you know what is holding him back, so that he may be revealed at the proper time.

7 For the secret power of lawlessness is already at work; but the one who now holds it back will continue to do so till he is taken out of the way.

8 And then the lawless one will be revealed, whom the Lord Jesus will overthrow with the breath of his mouth and destroy by the splendor of his coming.

9 The coming of the lawless one will be in accordance with how Satan works. He will use all sorts of displays of power through signs and wonders that serve the lie,

10 and all the ways that wickedness deceives those who are perishing. They perish because they refused to love the truth and so be saved.

11 For this reason God sends them a powerful delusion so that they will believe the lie

12 and so that all will be condemned who have not believed the truth but have delighted in wickedness.

Stand Firm

13 But we ought always to thank God for you, brothers and sisters loved by the Lord, because God chose you as first fruits to be saved through the sanctifying work of the Spirit and through belief in the truth.

14 He called you to this through our gospel, that you might share in the glory of our Lord Jesus Christ.

15 So then, brothers and sisters, stand firm and hold fast to the teachings we passed on to you, whether by word of mouth or by letter.

16 May our Lord Jesus Christ himself and God our Father, who loved us and by his grace gave us eternal encouragement and good hope,

17 encourage your hearts and strengthen you in every good deed and word.

The Law can be used to show that they are not going to heaven without salvation through Jesus Christ.

However, Hebrews 10 states,

1 The law is only a shadow of the good things that are coming-not the realities themselves. For this reason, it can never, by the same sacrifices repeat endlessly year after year, make perfect those who draw near to worship.

2 I f it could, would they not have stopped being offered? For the worshippers would have been cleansed once and for all, and would no longer have felt guilty for their sins.

3 But those sacrifices are an annual reminder of sins

4 because it is impossible for the blood of bulls and goats to take away sins.

5 Therefore, when Christ came into the world: Please forward to verse eight

8 First he said, “Sacrifice and offerings, burnt offerings and sin offerings you did not desire, nor were you pleased with them” (although the law required them to be made).

9 Then he said, “Here I am, I have come to do your will.” He sets aside the first to establish the second.

10 And by that will, we have been made holy through the sacrifice of the body of Jesus Christ once and for all.

11 Day after day every priest stands and performs his religious duties, again and again he offers the same sacrifices, which can never take away sins.

12 But when this priest (Jesus Christ who is ‘The One’) had offered for all time one sacrifice for sins, he sat down at the right hand of God.

13 Since that time he waits for his enemies to be made his footstool,

14 because by ONE sacrifice he has made perfect forever those who are being made holy.

15 The Holy Spirit also testifies to us about this.

First, he says:

16 “This is the covenant I will make with them after that time, says the Lord. I will put my laws in their hearts, and I will write them on their minds.”

17 “Their sins and lawless acts I will remember no more.”

18 And where these have been forgiven, there is no longer any sacrifice for sin.

In conclusion, I say,

19 Therefore, brothers, since we have confidence to enter the Most Holy Place by the blood of Jesus,

20 by a new and living way opened for us through the curtain, that is his body,

21 and since we have a great priest over the house of God,

22 let us draw near to God with a sincere heart in assurance of faith, having our hearts sprinkled to cleanse us from a guilty conscience and having our bodies washed with pure water.

23 Let us hold unswervingly to the hope we profess, for he who promised IS FAITHFUL.
